Drug Free Workplace Policy

 

It is the policy of Kansas State University that the unlawful manufacture, distribution, dispensing, possession or use of controlled substances is prohibited in its workplace.  Any employee of the University, including faculty, other unclassified staff, classified staff, and student employees, found to illegally manufacture, distribute, dispense, possess, or use controlled substances in any part of the University workplace shall be subject to appropriate disciplinary action, up to and including termination, in accordance with applicable policies of the State of Kansas, the Board of Regents and Kansas State University.

 

Copies of this policy will be distributed to employees engaged in the performance of a federal grant or contract.  Such employees, as a condition of continued employment must abide by the terms of this policy and must notify the Provost of any criminal drug statute conviction for a violation occurring in any part of the workplace at Kansas State University no later than five days after such conviction.  For purposes of this policy, "conviction" means a finding of guilt (including a plea of nolo contendere) or imposition of sentence, or both, by a judicial body charged with responsibility to determine violations of the federal or state criminal drug statutes.

 

The term "controlled substance" as used in this policy means those substances included in schedules I through V of Section 202 of the Controlled Substances Act and is further defined by regulation at 21 C.F.R. 1300.11 through 1300.15.  The term does not include the use of medically prescribed drugs or other uses authorized by law.

 

In 1988, Congress passed the Drug-Free Workplace Act.  This Act applies to all institutions holding and applying for federal grants and contracts.  In compliance with the Act, Kansas State University adopted this policy, effective March 18, 1989.

 

This policy is an integral part of Kansas State University's drug-free awareness program and will be communicated to all employees within the context of that program.
